These terms and conditions may be modified by SLEEPFAIR at any time, with the user being informed of the existence of any new version containing substantial changes.

  1. The User

Accessing, browsing, and using the website confer user status, and by initiating navigation on the website, all the conditions established here are accepted, along with their future modifications, without prejudice to the application of the corresponding legally mandatory regulations as appropriate. The user assumes responsibility for the correct use of the website, limited to:

  • Using the website solely for legitimate inquiries and purchases.
  • Not engaging in any false or fraudulent purchases.

Providing accurate and lawful contact details, such as email address, phone number, postal address, and/or other information.

  • The user declares to be at least 21 years old and to have legal capacity to enter into contracts through this website. The website is primarily intended for users residing in the United States. SLEEPFAIR does not guarantee compliance with the laws of other countries, either in whole or in part.
  1. Applicability of the General Conditions

These conditions apply to all quotations, offers, activities, agreements, and product deliveries by or on behalf of SLEEPFAIR. Deviation from these conditions is only possible if explicitly agreed upon in writing by the parties.

  1. Purpose

These conditions govern the use of the website WWW.SLEEPFAIR.COM made available to its users and customers. Purchases on WWW.SLEEPFAIR.COM can only be made from the United States. The products sold by SLEEPFAIR through its website are primarily home items, mainly mattresses, box springs, bed frames, and pillows. SLEEPFAIR may modify them without prior notice, recommending periodic consultation, especially when using its online store on the website WWW.SLEEPFAIR.COM. However, SLEEPFAIR commits to keeping them updated, publishing the latest version, and allowing access and printing at any time.

  1. Access and Purchase Conditions

 

Access to the SLEEPFAIR Portal is free and grants the user status, regardless of the subsequent use of the offered services. The user must register to make purchases in the store, completing a form that involves assigning personal credentials, including a unique identifier (email address) and a password, for which the user is solely responsible. The acquisition of products on WWW.SLEEPFAIR.COM can only be made by users over 21 years old, following the steps and instructions accompanying the entire purchasing process, including:

(i) Completing the registration form or identifying registered users;

(ii) Displaying on-screen the order summary, delivery conditions, and shipping costs, if any;

(iii) Acceptance of purchase conditions, implying the reading, understanding, and irrevocable acceptance of all these General Conditions, as well as, if applicable, existing Particular Conditions;

(iv) Immediate receipt of an order summary email to the registered account or, if not, as soon as possible and always within twenty-four hours. The acquisition of products on WWW.SLEEPFAIR.COM for subsequent distribution or resale, whether in public establishments or domestic settings, is not allowed. SLEEPFAIR will regulate and authorize the necessary permits if it ever consents, duly notifying such authorization to the authorized agent.

  1. Orders

No valid order can be placed without expressly accepting the terms, conditions, and privacy policy of SLEEPFAIR through the designated checkboxes. All orders are considered purchase offers subject to these terms and conditions. SLEEPFAIR reserves the right to accept them if the requirements outlined herein are not met. Upon placing an order, the system automatically generates an acknowledgment of receipt. However, this confirmation does not imply automatic acceptance of the order, as SLEEPFAIR reserves the right to obtain additional information related to identity and address to ensure proper order shipment and prevent transaction-related fraud. Orders can be placed 365 days a year, at any time, except when the service is suspended for maintenance or other commercial and/or force majeure circumstances. Any order is subject to product availability. If it is not possible to deliver an order due to supply problems or insufficient stock, the user has the option to wait until the product is available or cancel the order.

WWW.SLEEPFAIR.COM is not obligated to supply any product at an incorrect price if the error is easily and unmistakably recognizable, even if an automated order confirmation message has been received. If you detect an obvious error, please contact us if you have any doubts to avoid misunderstandings later. If we detect the error first, we will contact you at some point in the purchasing-payment and/or transportation process to confirm the price error before product delivery/shipping. All items with excluded transportation must be paid by the customer in addition to the set price. Each item explains in its product profile whether transportation is included or not.

  1. Delivery

Delivery is considered to have occurred when the user or a third party designated by them acquires physical possession of the products. The delivery period for the order will vary depending on the selected shipping method and will be indicated on the website once the order confirmation is obtained. In any case, it will not exceed 15 days from the date of the order confirmation. If the delivery date cannot be met, the user will be informed of this circumstance, and the option to proceed with the purchase by setting a new delivery date or canceling the order with a full refund will be offered. If the recipient is absent at the time of delivery, a notice will be left for them to collect the product from the company within the specified time frame. If the deadline passes without the product being collected, the shipment will be returned to SLEEPFAIR.

  1. Price and Payment

The price of each product is understood to be the one displayed on the website at the time of each order. The user must pay the marked price, including applicable taxes, along with shipping costs, which will be added to the final amount to be paid. Prices may be changed by SLEEPFAIR at any time without notice, without affecting confirmed orders. However, even if confirmed, SLEEPFAIR is not obligated to fulfill orders when the price is incorrect, especially if the error is manifest and easily recognizable. Accepted payment methods include credit or debit card payment. We reserve the right to NOT accept certain payments with specific credit cards. Payment can also be made through a payment platform, bank transfer, or in cash. SLEEPFAIR reserves the right to change payment methods, including creating new ones or eliminating existing ones, without the user/customer of WWW.SLEEPFAIR.COM being able to make claims for this reason. However, if the change in the payment method affects an already placed order, SLEEPFAIR will offer the option to cancel the order if the user deems it appropriate. Credit/debit card payment is processed online, in real-time, through the respective financial institution, once it has been verified that the communicated data is correct. To ensure maximum security for the WWW.SLEEPFAIR.COM payment system, SLEEPFAIR uses secure payment systems from leading financial entities in e-commerce. In this regard, confidential data is transmitted directly and encrypted (SSL) to the corresponding financial entity. The SSL encryption system used provides total security for data transmission over the network. Customer data is completely confidential and protected. Credit card data is not stored in any database of our company. It is used solely in the virtual POS (Point of Sale) of SLEEPFAIR’s financial entity, through its Secure Payment Gateway. Credit cards will be subject to checks and authorizations by the issuing entity, but if that entity does not authorize payment, SLEEPFAIR is not responsible for any delays or non-deliveries and cannot formalize any contract with the customer. SLEEPFAIR reserves the right to verify the personal data provided by the customer and take the measures it deems appropriate (including canceling the order) to ensure that the purchased goods are delivered in accordance with the data specified in the order.

  1. Customer Service

SLEEPFAIR has a customer service to manage complaints, doubts, or information requests. Users can contact SLEEPFAIR’s Customer Service via email at sleepfair@gmail.com or by calling 1 (855) 737-0200, Monday to Friday (9:30 am to 1:00 pm and 2:00 pm to 6:00 pm). All queries, complaints, and suggestions will be addressed promptly, with a written receipt provided.

  1. Language of the Contract

These general sales conditions are drafted in English. In case of translations into other foreign languages, the Spanish text will prevail in case of a dispute.

  1. Exchange

Under the terms and conditions, the customer can exchange the product for another of higher value, retaining the best option offered by SLEEPFAIR. The maximum exchange period is 30 days. Exchange is not valid in cases of irreparable damage attributable to the consumer, use of a faulty base, liquid stains, or unauthorized repair.

  1. Delivery

 

The delivery time can vary from 48 to 72 hours, depending on the products you wish to purchase and the service route. The delivery service operates from Monday to Saturday, excluding Sundays and national or local holidays. No specific time will be scheduled.

The delivery period begins when your order is processed. SLEEPFAIR will communicate this circumstance to you via email, WhatsApp, or phone (within a maximum of 1 day after making the purchase). The merchandise will be delivered, but it does not include home delivery, unpacking, assembly, or removal of items. Alternatively, you can negotiate with the delivery person for these additional services.

If the order cannot be delivered due to special circumstances in your delivery area and you have not informed us of this, you may cancel the order. However, you will be responsible for the transportation costs incurred for the return and the packaging of the products.

Special circumstances in your own home: SLEEPFAIR sells large-sized products that may have difficult access to your own home. You must inform SLEEPFAIR of these circumstances to ensure that, once the product is shipped, it has access to your home (whether it is the entrance to the building or your property). If you do not inform SLEEPFAIR and the product cannot be delivered due to this circumstance, you will be responsible for the transportation costs of the product return and any costs incurred due to the manufacturing of the order (customized or personalized products specifically for you).

The transportation company will not make deliveries at height, meaning through building facades or interior courtyards, nor will they use any pulley system to introduce the order into the building or the home itself. It is the customer’s responsibility to ensure that the items can be installed. The order will be considered delivered when received at your home. The acceptance of the delivery implies your acknowledgment. Transporters typically require the signature of the person receiving the order, which is valid for confirming the delivery.

We will attempt to deliver the order twice to the address you provided. If delivery is not possible after these two attempts, we will contact you to find a solution. Please note that transportation incurs a cost. If we cannot contact you after 7 days, we will assume that you wish to terminate the contract, and we will consider it concluded.

We will refund the paid amount as soon as possible, setting a maximum period of 30 days to do so. In this case, we may deduct from the refund the costs incurred for transportation, contract resolution, bank commissions, considering that if the merchandise is specifically ordered for you in terms of size, color, etc., the money cannot be refunded.

 

  1. Returns

The customer has a maximum period of 7 days to return the product in its original condition. For the return, the customer must deliver the product undamaged, without stains or signs of excessive use, in its original packaging, with the purchase receipt, and specifying the reason for the return.
